Abstract
El presente artículo, tiene por finalidad dar una perspectiva a los fundamentos que justifican las causales de reservas invocadas en un proceso de contratación administrativa, llevado a cabo por las Fuerzas Armadas y las Fuerzas de Orden y Seguridad. Dichos procesos justifican su reserva principalmente en las disposiciones contenidas en el artículo 436 del Código de Justicia Militar, artículo que se encuentra redactado en términos generales y no taxativos, por lo que su invocación debe estarse a lo que el artículo 21 de la Ley N° 20.285, diga al respecto, pero antes de eso, debe verificarse lo que en este trabajo llamaremos “test de control previo” , respecto del daño e interés público, que reservarán y darán sustento al acto administrativo que acceda a esta forma especial de procedimiento de compras.
This article, has the objective to give a perspective to the grounds that justify the causes of reservations invoked in an administrative contracting process, carried out by the Armed Forces and the Forces of Order and Security. These processes justify their reservation mainly in the provisions contained in article 436 of the Code of Military Justice, an article that is drafted in general and non-exhaustive terms, so its invocation must be in accordance with article 21 of Law No. 20.285, say about it, but before that, what in this work we will call "prior control test" must be verified, with respect to damage and public interest, which will reserve support for the administrative act that accesses this special form of purchasing procedure.
