In this paper a briefly review of the history of higher education is made, along with this, the most relevant jurisprudence of recent times is analyzed, from the criterion of the control of legality, about the accreditation decisions of the National Accreditation Commission. The analysis is also carried out on the prevailing legislation on accreditation, with regard to higher education institutions, in light of the changes experienced in the accreditation system of the National Accreditation Commission. Finally, the need to extend the recursive mechanisms to other grounds is presented, as well as the importance of a control of legality in the accreditation decisions making by the National Accreditation Commission.
