The objective of this article is to carry out a study of the sentence that the Constitutional Court declared as unconstitutional certain percepts with respect to the modification of Law 21,081, which tried to establish new powers to SERNAC to expand and strengthen the protection of the rights of the consumers. In this work the opinion of the judges will be exposed, which made it clear that there are points of view that must be addressed for future reforms that aim to guarantee the rights of consumers.
