- Resumen
In Chile, concern about climate change related to cases of environmental pollution resulting from violation of the legal framework that regulates the environment, has led the State in the legislative evolution to create a new legal statute of protection for this legal interest. On August 17, 2023, Law No. 21,595 on economic crimes and attacks against the environment was published, which introducing amendments to the Penal Code. This provision creates new environmental crimes, whit the aim of punishing whit custodial sentences those behaviors that affect or damage various components of the environment, marking a significant milestone in the environmental protection of our country.
