Situación jurisprudencial en torno a los permisos municipales de uso u ocupación de bienes nacionales de uso público

Abstract

This article means to state the jurisprudential tendency of the Administrative and Superior Courts ofJustice, when it comes to know about actions and / or resources associated with use or occupation of township permits granted on national assets for public use by townships in view of the article 36 of the LOCM. The aforementioned is aimed especially at visualizing the position of the Jurisprudence on the precarious essence of said permits and the discretional power of mayors to grant, modify and revoke them, in the sense of determining whether, at the time of revoking a township permit, the mere reference to the precarious essence of these is sufficient, or, if that decision should also be substantiated by the law.
