La regulación del abuso patrimonial hacia la persona mayor en Chile: Actualidad y perspectivas

Abstract

The aging population in Chile generates several challenges, one of them is the regulation of the different types of abuse, among which is patrimonial abuse. The objective of this research is to review and analyze the state of the regulation of property abuse in Chile compared to two countries on the continent. Thus, the legal methodology used during the research was dogmatic and comparative analysis. Where three jurisprudence results associated with writ of protection and protection measures in family courts were obtained, which evince the lack of rulings in which our courts of law pronounce on the matter in question, which is intimately linked to the insufficient legal regulation on the subject, this would also justify the scarce jurisprudence that existed during the pandemic. Finally, we can conclude that the structured regulation of patrimonial abuse in Chile is a pending challenge.
