| dc.description.abstract | La presente investigación tiene por objeto la descripción del proceso de constitución del patrimonio hídrico Likanantay, acciones jurídico - administrativas ejecutadas, detalle programa de regularización de derechos de aprovechamiento de aguas de CONADI, hitos en el proceso de formación, derechos de aguas regularizados. Descripción cronológica de la normativa aplicable de tipo constitucional y legal, y ésta, de carácter general y aquella que trata de asuntos indígenas, como la ley 19.253 y Convenio 169 de la OIT. Revisión secuencial temporal de la diversa jurisprudencia generada en proceso de constitución del patrimonio hídrico Likan Antay, elaborando índice temporal con justificación de su inclusión y determinación de la jurisprudencia. Descripción y análisis de sentencias de los tribunales superiores de justicia de relevancia, según descripción e índice elaborados, que hayan establecido principios y/o criterios jurídicos de valor para comunidades indígenas. | |
| dc.description.abstract | The purpose of this research is to describe the process of constituting the Likanantay water heritage, executed legal-administrative actions, detail of the regularization program for CONADI water use rights, milestones in the formation process, regularized water rights. Chronological description of the applicable constitutional and legal regulations, and this, of a general nature and that which deals with indigenous issues, such as Law 19,253 and ILO Convention 169. Temporal sequential review of the diverse jurisprudence generated in the process of constituting the Likan Antay water heritage, preparing a temporary index with justification for its inclusion and determination of the jurisprudence. Description and analysis of sentences of the superior courts of justice of relevance, according to the description and index elaborated, that have established principles and/or legal criteria of value for indigenous communities. | en |
