dc.description.abstractEl presente artículo, tratará de exponer la problemática que ha tenido la jurisprudencia administrativa de la Contraloría General de la República, como a nivel regional, al poder determinar el sentido y alcance de la potestad que consagra el inciso segundo del artículo 86°, del Reglamento de Sumarios Administrativos de Carabineros de Chile, N° 151, que establece en síntesis, que la autoridad dictaminadora es competente para sancionar a todo el personal que al término de un sumario resulte responsable, aun cuando dependiere de otra jefatura. La problemática anterior se produce porque existen ciertas Contralorías Regionales, que han representado determinadas resoluciones que dan término a sumarios administrativos instruidos por Carabineros de Chile, por considerar que la autoridad que dispuso la eliminación de un funcionario, que ordenó instruir un proceso administrativo y que finalmente resolvió el Sumario, no era competente, según lo establecido en el artículo 86°, inciso segundo, del Reglamento N° 15, conforme a los casos que se pasaran a exponer en este artículo académico.es
dc.description.abstractThis article, will expose the problems who has the administrative jurisprudence of the the Comptroller General of the Republic, at the regional level, by being able to determine the meaning and scope of the power enshrined in the second paragraph of article 86, of the Regulation of Administrative Summaries of Carabineros de Chile, No15, which establishes in summary that the ruling authority is competent to sanction all personnel who, at the end of a summary, are responsible, even when it depends on another leadership. The above problem occurs because there are certain Regional Comptrollers' Offices that have represented certain resolutions that terminate administrative proceedings conducted by Carabineros de Chile, considering that the authority that ordered the removal of an official, that ordered to instruct an administrative process and that finally resolved the Summary, was not competent, as established in Article 86, second paragraph, of Regulation No. 15, in accordance with the cases that will be exposed in this academic article.en
