dc.description.abstractLa Ley Orgánica de la Superintendencia del Medio Ambiente (en adelante LO-SMA) entrega a los regulados incentivos de cumplimiento previo o una vez que se inicia un procedimiento administrativo sancionatorio. A pesar de ello, la institucionalidad ambiental ha innovado en proponer medidas alternativas, como la Corrección Temprana, previas al proceso de sanción y en el espacio de la fiscalización ambiental. Sin embargo, se requiere fortalecer el marco legal vigente para que la Corrección Temprana tenga la misma validez que los oficiales, es decir, la Autodenuncia, el Programa de Cumplimiento y el Plan de Reparación, permitiendo así dar certeza jurídica para su implementación.es
dc.description.abstractThe Organic Law of the Superintendency of the Environment gives the regulated incentives for prior compliance or once a sanctioning administrative procedure is initiated. However, the environmental institutions have innovated in proposing alternative measures, such as Early Correction, prior to the sanction process and in the space of environmental enforcement. Nevertheless, it is necessary to strengthen the current legal framework so that the Early Correction has the same validity as the official ones, that is, the Self-Report, the Compliance Program and the Repair Plan, thus allowing legal certainty for its implementation.
