This academic article seeks to determine whether it is possible to declare the decay of the administrative procedure through an appeal for protection, taking into consideration the requirements of this and the existence of violations of constitutional guarantees when there is excessive delay in the processing of an administrative procedure. This is done through an analysis of judicial and administrative jurisprudence and current regulations and changes in criteria over the years.
