Siendo el objetivo de esta investigación el revisar y analizar el estado de la regulación del abuso patrimonial en Chile en comparación con dos países del continente. Así, la metodología jurídica utilizada durante la investigación fue la de análisis dogmático y comparado. Donde se obtuvieron tres resultados de jurisprudencia asociados a recursos de amparo y medidas proteccionales en tribunales de familia, que dejan en evidencia el escaso número de fallos en que nuestros tribunales de justicia se pronuncian sobre la materia en cuestión, lo que se encuentra íntimamente ligado a la insuficiente regulación jurídica sobre el tema, esto además justificaría la escasa jurisprudencia atingente durante la pandemia. Pudiendo concluir finalmente que es un desafío pendiente la regulación orgánica del abuso patrimonial en Chile.The aging population in Chile generates several challenges, one of them is the regulation of the different types of abuse, among which is patrimonial abuse. The objective of this research is to review and analyze the state of the regulation of property abuse in Chile compared to two countries on the continent. Thus, the legal methodology used during the research was dogmatic and comparative analysis. Where three jurisprudence results associated with writ of protection and protection measures in family courts were obtained, which evince the lack of rulings in which our courts of law pronounce on the matter in question, which is intimately linked to the insufficient legal regulation on the subject, this would also justify the scarce jurisprudence that existed during the pandemic.
