Luego, la falta de servicio, como el factor de atribución por antonomasia de esta responsabilidad, exige determinar cuál es el modelo de conducta o estándar que el ciudadano puede exigir de su administración, correspondiendo al juez su construcción, ya de una manera objetiva, contrastándolo con un deber, o bien, de una manera subjetiva, considerando las condiciones fácticas en la que el daño ha tenido lugar. De la aplicación de uno u otro estándar va a depender derechamente la extensión de la falta de servicio y consecuencialmente la mayor o menor minuciosidad del operador jurídico en la defensa de sus intereses, constituyéndose en un factor determinante en el resultado de la acción deducida contra el Estado.The responsibility of the State constitutes one of the legal principles that make up a State governed by the rule of law. Then, the lack of service, as the factor of attribution par excellence of this responsibility, requires determining what is the model of conduct or standard that the citizens may demand from their administration, and the judge is responsible to build it. This can be carried out in an objective manner, contrasting it with a duty, or in a subjective manner, considering the factual conditions in which the damage has taken place.
