Dichos procesos justifican su reserva principalmente en las disposiciones contenidas en el artículo 436 del Código de Justicia Militar, artículo que se encuentra redactado en términos generales y no taxativos, por lo que su invocación debe estarse a lo que el artículo 21 de la Ley N° 20.285, diga al respecto, pero antes de eso, debe verificarse lo que en este trabajo llamaremos “test de control previo” , respecto del daño e interés público, que reservarán y darán sustento al acto administrativo que acceda a esta forma especial de procedimiento de compras.This article, has the objective to give a perspective to the grounds that justify the causes of reservations invoked in an administrative contracting process, carried out by the Armed Forces and the Forces of Order and Security.
