Neuroderechos: la protección de la actividad cerebral y la información proveniente de ella frente al uso de las neurotecnologías. Breve descripción del estado del arte y análisis del avance del Estado de Chile en la materia

Abstract
El desarrollo de las neurotecnologías de Interfaz Cerebro Computadora, BCI, por las siglas del término en inglés (Brain Computer Interfaces), basada en el análisis de electroencefalograma e Inteligencia Artificial (IA), están permitiendo un acceso mayor y más rápido a la información acumulada en el cerebro de las personas otorgándole capacidad a las máquinas de leer nuestros impulsos mentales, procesarlos, interpretarlos y manipularlos. Ante este escenario un grupo de científicos proponen una legislación de vanguardia, actualizando o creando nuevos derechos humanos, acorde con el siglo XXI, la era digital y la tecnología del futuro.
El presente artículo pretende describir el origen y conceptualización de los denominados neuroderechos, dando cuenta del estado del arte en los principales instrumentos de legislación internacional, y analizar el caso de Chile país pionero en esta regulación de frontera.
The development of Brain Computer Interfaces (BCI) neurotechnologies, based on electroencephalogram analysis and Artificial Intelligence (AI), are allowing greater and faster access to the information accumulated in people's brains, giving machines the capacity to read, process, interpret and manipulate our mental impulses. Faced with this scenario, a group of scientists propose a vanguard legislation, updating or creating new human rights, in accordance with the 21st century, the digital era and the technology of the future. This article aims to describe the origin and conceptualization of the so-called neuro-rights, giving an account of the state of the art in the main instruments of international legislation, and to analyze the case of Chile, a pioneer country in this frontier regulation.
