| dc.description.abstract | Existe la discusión doctrinal acerca de si concierne al ART. 366 TER CÓDIGO PENAL que regula el delito de abuso sexual, incluir entre los elementos configuradores del tipo el ánimo lascivo del autor del delito como un elemento subjetivo que se agrega a los elementos objetivos que describe el artículo. En este artículo defenderemos la tesis afirmativa, pues existen casos ambivalentes donde los jueces del ramo no pueden declarar la significación sexual del acto sino averiguando las intenciones luctuosas que guían la conducta punible que se acusa. | |
| dc.description.abstract | There is a doctrinal discussion about whether it concerns ARTICLE 366 TER OF THE PENAL CODE, which regulates the crime of sexual abuse, to include among the elements that make up the type the lascivious intent of the perpetrator of the crime as a subjective element that is added to the objective elements described in the article. In this article we will defend the affirmative thesis, since there are ambivalent cases where the judges of the field cannot declare the sexual significance of the act except by ascertaining the mournful intentions that guide the punishable conduct that is accused. | |
